General Terms and Conditions of Sale for Consumer Customers

These general terms and conditions of sale govern the purchase of products and services made remotely via the Internet on the website www.tipicheriasalentina.it. Before submitting an order, the Customer is invited to carefully read these General Terms and Conditions, which are available on the website for consultation, storage, and archiving.

Definitions

Unless otherwise stated in the Contract, the following terms and expressions shall have the meanings specified below:
a) "Individual Company Perrotta Agnese": Refers to Perrotta Agnese, VAT number 05257950757, with its registered office in Martano (LE), Via Zaca, 70. Contact details: phone +39 379 195 0311, email info@tipicheriasalentina.it.
b) "Site" or "Website": Refers to the portal accessible at the URL www.tipicheriasalentina.it, owned by Perrotta Agnese.
c) "Customer": Represents the natural person who enters into the contract for the purchase of one or more products.
d) "Consumer" or "Consumer Customer": Refers to the Customer (natural person) acting for purposes unrelated to any entrepreneurial, commercial, artisanal, or professional activity that they may undertake.
e) "Professional" or "Professional Customer": Refers to the Customer (natural or legal person) acting within the scope of their entrepreneurial, commercial, artisanal, or professional activity, or through an intermediary.
f) "Parties": Refers to Perrotta Agnese and the Customer.
g) "Product": Includes any item available for purchase through the electronic catalog published on the Site. This catalog, which includes products such as jarred foods, tomato sauces, and olive oil, is constantly updated, and product availability may vary without prior notice.
h) "Access Credentials": Refers to the "username/email address" and "password" associated with the Customer's account, essential for accessing the reserved area of the Site and concluding a Contract.
i) "Business Days" and "Business Hours": Refers to the days from Monday to Saturday, excluding national holidays, with operational hours from 9:00 a.m. to 12:00 p.m. and 4:00 p.m. to 8:00 p.m.
j) "General Terms and Conditions": Refers to these General Terms and Conditions of Sale, which govern the contractual relationship between Perrotta Agnese and Consumer Customers.
k) "Contract": Consists of these General Terms and Conditions and the Order Confirmation. In the event of discrepancies between the General Terms and Conditions and the Order Confirmation, the latter shall prevail.

Contracting Parties

  1. The contracting parties are the Individual Company Perrotta Agnese and the Consumer Customer, identified through the personal data indicated in the Order Confirmation sent by the Individual Company Perrotta Agnese.
  2. The Contract entered into between the Individual Company Perrotta Agnese and the Consumer Customer is also governed by the provisions of Section II ("Pre-contractual Information for Consumers and Right of Withdrawal in Distance Contracts and Off-premises Contracts"), Articles 49-59, Section III ("Other Consumer Rights"), Articles 60-65, and Section IV ("General Provisions"), Articles 66-67, of Legislative Decree No. 206 of September 6, 2005 ("Consumer Code").

Subject of the Contract

  1. These General Terms and Conditions of Sale for Consumer Customers (hereinafter referred to as "General Terms and Conditions") regulate purchases made by Consumer Customers of the products included in the electronic catalog published on the website www.tipicheriasalentina.it (hereinafter referred to as "Site").

Purchase Procedure and Conclusion of the Contract

  1. The Customer, after registering on the Site, may purchase one or more Products available in the Site's electronic catalog, which are described and illustrated in the respective product sheets, by adding them to the "cart" and completing the technical access procedures provided by the Site.
  2. The publication of Products on the Site constitutes an invitation for the Customer to make a purchase offer to the Individual Company Perrotta Agnese. Before submitting the order, the Customer will be shown a summary page containing the selected Products, the total price, and any applicable delivery charges. The General Terms and Conditions and Privacy Policy can be consulted at this stage.
  3. The order submitted by the Customer constitutes a binding contractual proposal, implying full knowledge and acceptance of these General Terms and Conditions. The Customer is advised to print and save the order summary displayed at the end of the purchase procedure. The "notes" field in the electronic order form may only be used to provide operational instructions (e.g., the name on the intercom). This field does not bind the Contracting Parties in any way or contain exceptions to the General Terms and Conditions.
  4. The Individual Company Perrotta Agnese reserves the right to accept or reject, at its sole discretion, the order submitted by the Customer. In case of non-acceptance, the Customer may not make any claims or demands. The acceptance of the purchase proposal, if any, occurs through the transmission of an order confirmation email to the address provided by the Customer. The purchase Contract is deemed concluded upon the transmission of this confirmation, except as provided in paragraph 5 below.
  5. The Customer acknowledges that the order confirmation is automatically generated. Should the Individual Company Perrotta Agnese identify discrepancies regarding the price, features, or availability of the Product during packaging and shipment, the company will promptly notify the Customer to agree on any changes or cancel the order.
  6. The Customer, as a consumer, has the right to exercise the right of withdrawal according to the procedures and terms provided by law.

Product Description and Visual Representation

  1. The visual representation of products displayed on the Site, where available, generally consists of photographic images illustrating the products and/or their packaging. This representation is provided solely for illustrative purposes, and the Individual Company Perrotta Agnese does not guarantee an exact match between the image displayed on the Site and the actual product.
  2. In the event of discrepancies between the image and the description contained in the product sheet, the written description on the sheet shall always prevail.

Product Availability

  1. Customers may purchase only the products listed in the catalog published on the Site and in the quantities specified. Prices and availability listed in the catalog are subject to change at any time without notice.
  2. The Site clearly indicates the availability of products ready for shipment. However, the Customer acknowledges that, due to simultaneous access by multiple users or the time elapsed between loading the web page and adding the product to the cart, product availability may vary.
  3. Upon submission of the order, the Site's system checks the actual availability of the selected products and promptly informs the Customer in case of unavailability before payment is made.
  4. The Individual Company Perrotta Agnese undertakes to fulfill contractual obligations as quickly as possible. Should the estimated delivery times differ from those indicated on the Site, the Customer will be promptly informed via email. If delivery is not possible for any reason, the Individual Company Perrotta Agnese reserves the right to cancel the order and inform the Customer of the decision.

 

Prices and Delivery Costs

  1. The price to be paid is the one indicated on the order summary page before the order is submitted. All product prices on the Site are expressed in Euros and include VAT only. Any discounts applied are clearly displayed, indicating the original price, the discount percentage, and the final price.
  2. Shipping costs are calculated based on the total weight of the purchased products and the geolocation of the delivery address.
  3. The shipping cost amount, if applicable, is clearly indicated on the order summary page displayed to the Customer before confirmation.

Delivery Terms

  1. The Individual Company Perrotta Agnese accepts orders for delivery throughout Europe, including Switzerland. Products are shipped within the maximum period stated in the offer, while for time-limited offers (flash deals), the shipping period may commence at the end of the offer itself.
  2. Delivery times are generally indicated in the order confirmation and may also be visible on the product page or in the cart summary before completing the purchase. These times are indicative and not binding, as delays may arise due to circumstances attributable to the couriers.
  3. Unless otherwise indicated, Perrotta Agnese guarantees delivery within 10 working days from the receipt of the order. On average, delivery times are 24/48 working hours within Italy, except for the islands, where delivery time extends to 48/72 working hours.
  4. If the purchased products are found to be unavailable after receiving the order, Perrotta Agnese will issue a full refund of any amounts already paid by the Customer, with no additional charges.

Shipment Communication and Tracking

  1. The Customer will be provided, if available, with the name of the assigned courier and the shipment tracking code (waybill or "Tracking"), which allows monitoring the delivery status. This information will also be accessible within the Customer's user account.
  2. It is not possible to guarantee a specific date or time for delivery, as such details depend on the courier, the destination address, and the operational methods of the delivery service.
  3. Unless otherwise specified during the purchase process, delivery is intended to be at street level.

Verification Conditions at the Time of Delivery

  1. Upon delivery, the Customer must check that the packaging is intact, undamaged, and unaltered. Any anomalies, such as punctured or crushed packaging, must be immediately contested to the courier with a written reservation on the delivery document, specifying the type of anomaly detected.
  2. Once the delivery document is signed without reservations, the Customer can no longer make claims regarding evident damages or discrepancies.
  3. Any issues related to the integrity, correspondence, or completeness of the received products must be reported within 3 days of delivery by sending an email to info@tipicheriasalentina.it.

Payments

Payments for the Purchase Contract can be made via credit card, debit card, prepaid card, or Google Pay. The Customer must select the preferred payment method when completing the Contract.

Payment via Credit Card or Google Pay

  1. For purchases made using a credit card or Google Pay, the card information is transmitted and managed by an Intermediary through a secure connection, directly on the Intermediary's website responsible for the transaction. The accepted networks are indicated on the Site before the order is submitted.
  2. The credit card payment process takes place via a secure connection. During this procedure, the Customer must provide card details such as type, number, expiration date, and any security codes required by the Intermediary (e.g., security services like MasterCard SecureCode or Verified by Visa). A phone number is always required for potential contact.
  3. To ensure maximum security, Perrotta Agnese does not access the Customer's credit card number. The data is received exclusively by the financial institutions managing payment authorization. Perrotta Agnese is only informed of the transaction's outcome and does not store any credit card data.

Transport Documents and Invoicing

  1. For each Purchase Contract concluded via the Site, Perrotta Agnese will issue an invoice for the shipped products.
  2. The information provided by the Customer at the time of the order will be used for invoicing purposes. The Customer assumes full responsibility for the accuracy of this information, as changes cannot be made to the invoice once issued.

Shipping and Delivery Times

  1. Perrotta Agnese will process the order within 10 working days (excluding weekends and holidays) from receipt. Once processed, the order will be entrusted to the courier for delivery to the address indicated by the Customer in the order confirmation. Deliveries are generally made within 24/48 hours (excluding holidays and weekends) for most Italian regions, while for islands, the average time is 48/72 hours.
  2. In case of issues during transport that prevent delivery within the indicative times, the Customer must promptly report it to Perrotta Agnese, who will work to resolve the situation. Customers are advised not to contact Perrotta Agnese before the indicative time has elapsed, as relevant data may not yet be available to intervene with the courier.
  3. The processing and delivery times provided are purely indicative and not binding, as they depend on variables such as the courier's transportation phase. Perrotta Agnese guarantees delivery within 30 days from the Contract conclusion date, in compliance with applicable regulations. No liability will be attributed to Perrotta Agnese for deliveries made beyond the indicative times.
  4. Delivery times apply to products available in stock at the time of the order. Delays caused by force majeure, strikes, holidays, weather events, or other extraordinary circumstances cannot be attributed to Perrotta Agnese.
  5. Should delays occur compared to the times indicated on the Site, Perrotta Agnese undertakes to promptly inform the Customer via email.

 

Delivery of Products

  1. All deliveries are at the risk of the Individual Company Perrotta Agnese until the Customer or a third party designated by them takes physical possession of the products.
  2. The delivery terms indicated on the Site are for informational purposes only. However, the Individual Company Perrotta Agnese guarantees delivery within 30 days from the conclusion of the Contract unless otherwise communicated.
  3. Unless otherwise specified, products will be delivered to the street level.
  4. Delivery requires the presence of the Customer or their representative at the specified address. In case of absence, the courier will leave a notice with instructions for scheduling a new delivery.
  5. If delivery cannot be completed due to reasons attributable to the Customer, such as prolonged absence or failure to communicate with the courier, the Customer will be responsible for the shipping costs incurred by the Individual Company Perrotta Agnese.

Verification Procedures Upon Delivery of Products

  1. Upon delivery, the Customer must verify that the number of packages matches the transport document and that the packaging is intact, undamaged, or unaltered, including the sealing materials. Particular attention should be paid to any signs indicating damage to the shipped goods.
  2. Any damage to the packaging and/or products, discrepancies in the number of packages, or inconsistencies with the documentation must be immediately reported to the courier. The Customer must declare in writing that the products are accepted "with reservation for inspection" or specify that they are "damaged." Without such a declaration, no subsequent claims will be accepted. Additionally, the Customer must report any issues concerning the integrity, correspondence, or completeness of the products within 24 hours of delivery by communicating with the Individual Company Perrotta Agnese, under penalty of forfeiting the right to make a claim.

Force Majeure and Third-Party Events

  1. The Individual Company Perrotta Agnese cannot be held responsible for delays or delivery failures caused by force majeure events, unavailability of transport means, actions of third parties, or unforeseeable and unavoidable circumstances, such as adverse weather conditions, strikes, pandemics, or other extraordinary emergencies.
  2. In such cases, the sole proprietorship reserves the right to split, postpone, or cancel the scheduled delivery in whole or in part, or to terminate the Contract. In case of contract termination, the Customer will be promptly informed via email and will be entitled to a refund of the price already paid, excluding any additional compensation or indemnification.

Product Custody and Storage

  1. After delivery, the Customer is responsible for the custody and storage of the products, which must be handled with the necessary diligence according to their nature.
  2. Any damages to the products caused by negligence, carelessness, or improper storage by the Customer are not attributable to the Individual Company Perrotta Agnese, and in such cases, the Customer forfeits any warranty on the purchased products.

Warranty

  1. The Consumer Customer is entitled to the legal warranty for defects in the goods sold, as provided by the Civil Code, and the warranty for lack of conformity regulated by the Consumer Code.
  2. The Individual Company Perrotta Agnese guarantees the absence of manufacturing and material defects for a period of 12 months from the delivery date, subject to the limitations outlined in the exclusions and limitations of the warranty section.
  3. During the warranty period, defective products will be repaired or replaced at no additional cost to the Customer, including labor and spare parts. However, any downtime of the products caused by repairs does not result in an extension of the warranty.

Additional Legal Warranty for the Consumer Customer

  1. Pursuant to Articles 130 and 132 of Legislative Decree 206/2005, the Consumer Customer is entitled to a legal warranty of 2 years from the delivery date for non-conformity defects present at the time of delivery. A product is considered defective if:
    • It is not suitable for the usual use of goods of the same type;
    • It does not conform to the description or does not possess the qualities promised by the seller;
    • It does not offer the qualities and performances that the consumer can legitimately expect;
    • It is not suitable for a particular use communicated to the seller and accepted by them at the time of purchase.
  2. The Consumer Customer forfeits the rights deriving from the legal warranty if the non-conformity defect is not reported within 2 months from its discovery.
  3. The Individual Company Perrotta Agnese commits to replacing defective products with others of equal quality at no additional cost, provided they are returned in the complete original packaging. If replacement is not possible, the Customer is entitled to a refund of the price paid, excluding any further liability from the Individual Company Perrotta Agnese.
  4. The limitations and exclusions of the warranty are detailed in the dedicated section.

Exclusions and Limitations of the Warranty

  1. Shipping costs necessary to send the products to the Individual Company Perrotta Agnese for assistance are borne by the Customer, while those related to the return of repaired or replaced products are covered by the Individual Company Perrotta Agnese.
  2. The warranties provided in the "Warranty" and "Additional Legal Warranty for the Consumer Customer" sections do not apply if:
    • The products have been damaged due to the Customer's intentional or negligent conduct;
    • The products have been exposed to natural events, used improperly, or not in accordance with the provided technical instructions;
    • Repairs, maintenance, or modifications have been carried out by unauthorized personnel;
    • The Customer has failed to perform the necessary maintenance or has stored them improperly;
    • Defects or malfunctions result from normal wear and tear or deterioration of consumable parts or from use different from that for which the products were designed.
  3. If the Individual Company Perrotta Agnese determines that the defects found in the products are directly or indirectly attributable to the Customer, the latter will be required to cover the verification costs and any expenses for the return of the products, notwithstanding paragraph 1. The sole proprietorship, at its discretion or upon the Customer's request, may provide an estimate for repair (where applicable).

Manufacturer's Conventional Warranty

  1. In addition to the legal warranties, some products may benefit from a conventional warranty offered by the manufacturer. When possible and not excessively burdensome, the Individual Company Perrotta Agnese mentions such warranties in the product description. The terms and conditions of these warranties are defined exclusively by the manufacturer, who operates as a third party relative to the sole proprietorship.

Right of Withdrawal

  1. The Consumer Customer may withdraw from the contract without providing any reason within 14 days from the date the Customer or a third party, other than the carrier and designated by them, acquires physical possession of the goods.
  2. For multiple orders with separate deliveries, the withdrawal period expires 14 days after the delivery of the last product.
  3. To exercise the right of withdrawal, the Customer must send an explicit communication by letter or email to the following contacts:

  4. It is sufficient for the Customer to send the communication before the expiration of the withdrawal period to comply with the stipulated terms.
  5. Pursuant to Article 54, paragraph 4, of the Consumer Code, the Customer is responsible for proving the sending of the communication. Therefore, the use of a registered letter with acknowledgment of receipt or other means suitable to certify receipt by the sole proprietorship is recommended.

Effects of Withdrawal

  1. In the event of withdrawal, the Individual Company Perrotta Agnese will refund all payments received from the Customer, excluding delivery costs, without undue delay and in any case within 14 days from receipt of the withdrawal communication.
  2. The refund will be made using the same payment method chosen by the Customer for the initial transaction, unless otherwise agreed. No costs will be charged to the Customer for the refund. However, the refund may be suspended until the returned goods are received or the Customer has provided evidence of shipment.
  3. The Customer must return the goods to the Individual Company Perrotta Agnese at the address Martano (LE), Via Zaca, 70, without undue delay and in any case within 14 days from the withdrawal communication. The deadline is met if the goods are shipped before the expiration of the 14 days.
  4. Direct return shipping costs are borne by the Customer.
  5. The Customer is responsible for any diminution in the value of the goods resulting from handling other than what is necessary to ascertain their nature, characteristics, and functioning.
  6. Products returned damaged during shipping will not be refunded. The Individual Company Perrotta Agnese will document any damages with photographs upon receipt of the delivery.

Note: Pursuant to Article 59 of the Consumer Code, the right of withdrawal does not apply to:

  • Perishable products or those with a short shelf life;
  • Customized or tailor-made goods;
  • Sealed products which, once opened, cannot be returned for hygienic reasons or health protection.

Exclusion Cases for the Right of Withdrawal

The Consumer Client cannot exercise the right of withdrawal in the following cases:

a) Goods made to measure and/or clearly personalized.

b) Goods that are likely to deteriorate or expire quickly.

c) Sealed goods that, once opened after delivery, cannot be returned for hygienic or health-related reasons.

d) Sealed food products once opened.

e) Goods that, due to their nature, become inseparably mixed with other items after delivery.

Access Credentials

The Client is required to safeguard their access credentials (username and password) with the utmost care, confidentiality, and diligence, and not to share them with third parties. In the event of theft, loss, or unauthorized use of credentials, even partially, the Client must immediately notify Individual Company Perrotta Agnese. Any damages arising from failure to comply with these obligations are the Client's responsibility.

Individual Company Perrotta Agnese reserves the right to delete accounts that are not used for purchases within 90 days of registration, even without prior notice.

Disclaimer for Content Posted by Clients on the Website

Registered Clients can post comments, reviews, and opinions on products available in the electronic catalog. However, it is prohibited to use this feature for:

• Illegal purposes, including spamming, defamation, libel, threats, or privacy violations of others.

• Posting offensive content, slander, propaganda, advertisements, or references to competing websites.

Individual Company Perrotta Agnese reserves the right to remove any content deemed inappropriate, such as when the reviewed product is no longer for sale or the comments section is closed. Content is published free of charge, and Clients can delete it by accessing their account.

Although not obliged to monitor user-generated content, Individual Company Perrotta Agnese may remove it in case of proven violations, upon request by competent authorities or affected parties. Content removal may lead to the suspension or deletion of the Client's account without prior notice.

Modifications

Individual Company Perrotta Agnese reserves the right to modify these General Terms and Conditions at any time without prior notice.

Changes take effect from the date of publication on the Website.

For contracts already concluded, the General Terms and Conditions in force at the time of the agreement remain applicable unless otherwise agreed in writing between the Parties.

Minor Negligence and Limitation of Liability

Individual Company Perrotta Agnese is not liable for damages caused to third parties due to minor negligence.

The maximum amount of any compensation owed by Individual Company Perrotta Agnese, for any reason, shall not exceed the amount paid by the Client in execution of the contract.

Intellectual Property Rights

All trademarks, texts, images, photographs, graphics, and other works protected under intellectual and industrial property laws on the Website are the exclusive property of Individual Company Perrotta Agnese or their respective licensors.

Access to the Website and the purchase of products do not grant the Client any rights to use or exploit these contents.

Personal Data Processing

Individual Company Perrotta Agnese ensures compliance with applicable personal data protection laws. The complete privacy policy is available on the Website and can be consulted at any time before concluding the Contract.

Complaints and Support

The Client may submit complaints or request support by contacting Individual Company Perrotta Agnese through:

For products covered by the manufacturer's warranty, it is recommended to contact the manufacturer directly; contact details are provided in the warranty itself.

Complaints will be processed within 2 business days from receipt.

Failed Delivery and Storage Costs

In the event of a failed delivery, the courier will leave a notice with instructions for a new delivery. If the Client does not provide instructions within 48 hours of notification of storage, the shipment will be returned to the sender.

The Client will be responsible for the return shipping costs (equal to 100% of the initial cost) and any additional shipment costs incurred.

If the Client fails to be available for delivery within the contractual terms, the Contract will be considered terminated 15 days after the goods are returned to the sender. Individual Company Perrotta Agnese will refund the amount paid by the Client, deducting shipping and storage costs.
